论全球化趋势与主权理论的嬗变

Study on Globalization and Sovereignty

主权理论是现代国际法领域最重要的问题之一。全球化可以通过跨越国界的资金流动、技术交流、生产要素的合理配置 ,促进世界经济发展 ,给世界各国带来发展的机遇 ;与此同时 ,全球化及由此产生的国际经济相互依赖 ,向国家主权提出了严峻的挑战 ,传统的主权理论必然受到影响和冲击。在主权理论领域出现的一些思潮 ,如主权否定论、主权弱化论等在一定程度上也影响着对主权问题的正确理解。有鉴于此 ,一方面 ,我们必须坚持国家主权理论 ;另一方面 ,我们也应该看到国家主权是可以在平等的基础上受到限制和让渡的。只有这样 ,国家才能融合到世界经济发展的大环境中去 。

The theory of sovereignty is one of the important issues in the field of international law. Globalization can promote the development of world economy and provide the opportunities of development for the countries all over the world through transnational capital flow, technology exchange and reasonable allocation of productive elements. In the meantime, globalization and international economy which rely on each other have posed a critical challenge to the state sovereignty. Traditional theory of sovereignty has been impacted and affected by globalization. Some new ideological trends, such as sovereignty nagativism and sovereignty weakening, affect people’s proper understanding of sovereignty to some extent. So, on one hand, we should maintain the principle of state sovereignty; on the other hand, we should realize that the state sovereignty can be restricted and developed on the basis of equity. Only by doing so can the state mix with the development of world economy and promote the development of domestic economy.
