Criminalization and non-criminalization in the judicial crimes:an analysis from the perspective of rent-seeking economics

以“寻租经济学”理论为基点 ,探讨了市场经济条件下 ,法定犯罪中的权力设租行为、寻租现象及形成原因 ,并据此提出减少设租 ,实行非犯罪化 。

This paper analyses rent-seeking behavior through the political power in the legal crime with respect to its causes. The analysis is based upon the rent-seeking economics.The paper proposes some key concepts such as de-crimination the legal crime,decreasing the rent,and raising the criminal efficiency,etc.
