浅析医疗诉讼中“举证责任倒置”对医患关系的影响

Influence of Upside-down Onus Probandi on the Relationship between Doctor and Patient

最高人民法院规定医疗纠纷诉讼适用“部分举证责任倒置” ,究其原因 ,是患者相对医院处于弱势 ,以及医疗事故鉴定结论的公信力受到质疑。文章分别分析了“举证责任倒置”对医患双方产生的潜在影响 ,认为医患双方是相互依存的关系 ,只有相信法律的公正 ,才能促使医患关系健康发展。

The highest people's court formulates that upside-down onus probandi is applied in lawsuit of medical dissension. The reason for upside-down onus probandi is formed is that it is difficult for patient to show proofs and the justice of conclusion of regulation of malpractice is doubted. This paper analyzes the potential influence of upside-down onus probandi on doctor and patient. The authors think that doctor and patient are depend on each other. Only is the justice of law believed,the relationship between doctor and patient would develop healthily.
