摘要
根据我国土地国有制的规定 ,土地使用者通过出让或转让方式获得的土地使用权 ,一方面虽然具有相对的独立性 ,另一方面却受到包括土地使用期限、国家收回权、国家无偿取得等规定的制约 ,从而客观上限制了房屋所有权的完整性。要解决此问题 ,需要进一步协调好土地所有权和使用权的关系 ,通过修改有关合同条款、完善立法等渠道 ,制定出我国完整的房屋所有权制度。
According to the policy for using the state-owned land in China,land-users can acquire the right to use the land being sold or transferred.On one hand,the land users are relatively independent,on the other hand,they are subjected to the restraints from many regulations,such as the fixed period of land use,the government's right to take the land back and get it property free of charge.As a result,it has in fact changed the complete right of the house ownership.To solve this problem,appropriate work should be done to adjust the relationship between land ownership and land use,and to work out relevant policy for the complete right of house ownership by means of revising relevant contracts and perfect the legislation.
