摘要
中日两国机动车事故损害赔偿的法律适用、赔偿责任主体、赔偿责任原则和范围的确定、机动车责任保险等法律制度等方面存在诸多的异同,文章对之进行了分析,作者认为,借鉴日本先进立法经验对制定和完善我国的机动车事故损害赔偿法律制度是有意义的,在此基础上,作者对我国在这方面的立法提出了若干建议。
In a comparative perspective this article analyzes the Chinese and Japanese legal systems such as the concrete adaptations in the compensation for damages in motor vehicle accidents, compensation liability subject, compensation liability standard and extent, and motor vehicle liability insurance. With references to foreign legislative experiences several proposals have been given as regards formulating and perfecting the Chinese legal systems of compensation for damages in motor vehicle accidents.
