论社会转型与现实宪法的产生

Society Transformation and Emergance of Practical Constitutioanl Law

现代社会是法治社会 ,它要求社会的各个方面都有法律上的依据 ,特别是宪法上的依据。而社会是发展的社会 ,社会转型是社会发展的一种特殊形式 ,它必然会带来社会生活方方面面的变化。当成文宪法的内容没有涉及到转型后的社会生活的变化时 ,现实宪法就产生了 ,以弥补成文宪法的不足 。

Modern society is a society ruled by law.It demands all the fields of the society should be ruled by law, especially by the constitutional law.But the society is developing, as a special form of the social development,society transformation must bring the changes to all the fields of the social life. When the written constitutional law doesn't concern these changes of the transformed social life ,the practical constitutional law will come into being to make up for the defects of the written constitutional law and give the constitutional supports to the continuously developing society.
