取保候审制度的实施问题及立法完善

取保候审制度是我国刑事诉讼中一项重要的强制措施 ,具有预防性和权利保障性的双重属性。在司法实践中 ,取保候审制度的实施还存在诸多问题 ,如适用条件、监督审查、法律救济等 ,所以有必要进一步从立法和体制等方面对取保候审制度进行完善 ,以促进我国的诉讼民主化进程。

Recognizance system is an important compulsory measure in our country's criminal suit.It is of the double attribute of preventation and right protection.But in the judicial practice,a host of problems still exist in the implementation of the system,such as suitable conditions,supervision and examination,and law succour,therefore it is necessary to further improve the system from legislation structure so as to promote the lawsuit democratization process of our country.
