摘要
辩诉交易蕴涵益于司法公正的因子。扫清观念和制度障碍 ,完善控辩审相互平衡机制 ,注重利益衡平 ,净化司法环境 ,化弊为利地移植辩诉交易制度 ,在中国是可以有助于实现司法公正的。
The deal between defence and litigation is a factor which may benefit fairness of legal system.Overcoming the obstacles in concept and system,improving balance system between litigation and defence,paying attention to the balance of interests,cleaning the environment of legal system,making defects become advantages and transplanting exchange system between defence and litigation may help legal system realize its fairness in China.
