法人人格权之保护与精神损害赔偿

The Protection of Rights of Legal Person and Mental Distress Compensation

法人作为民事主体,与自然人一样具有法律上的独立人格,当法人的人格权受到侵害时,其有权要求精神损害赔偿。从分析法人的人格权入手,论证了法人可作为精神损害赔偿的权利主体,在我国有必要建立法人的精神损害赔偿制度,以弥补法人人格权遭受侵害而带来的精神利益的损失并给致害者以惩罚。同时阐述了法人精神损害赔偿的范围及法人精神损害赔偿制度的性质与功能。

Legal person as well as natural person is legally a separate entity and therefore is entitled to claim mental distress compensation for damage to the rights of legal person.The paper,based on an analysis of legal person as an entity with rights,argues for the need to establish a legal sysem of mental distress compensation so as to make up for the loss caused by damage to the rights of legal person,and to punish infringers.Also,this paper formulates the scope of mental distress compensation,and the nature and function of the system.
