对我国刑法的女性主义思考

Feminist Reflections on China's Criminal Law

从女性主义的角度看,我国刑法一方面体现了对女性的尊重:设置了一系列的罪名惩罚对女性的犯罪,平等的保护所有的女性,尊重女性生育的选择权等;另一方面在立法者的潜意识里,存在着歧视女性的倾向:女性是弱者,只有女性(包括儿童)才能被拐卖、被收买,只有女性才能被强奸。文章对以上两方面进行了分析,并提出了修改刑法的有关建议。

In the feminist perspective China's Criminal Law on the one hand manifests respect for women in the fact that it has designed a whole battery of punishments for crimes against women, equal protection for women, respect for their right to the choice of childbirth; on the other hand, it manifests sexism in the legislators' subconsciousness in the fact that they regard women as being among the disadvantaged group, that only women(including children)can be bought or sold, and that only women can be raped. The essay analyses the afrementioned two aspects, coupled with some suggestions for amendments to the criminal Law.
