完善我国农业行政执法体系的对策

Measures of the Improvement on China Agriculture Administrative Execution System

农业行政执法体系作为有关农业行政执法的制度性规范总和 ,其基本框架包括行政执法的原则、执法主体、执法行为、执法程序和执法监督机制等内容。农业执法是我国农业法制建设的薄弱环节 ,又是依法治农最关键的环节。特别是我国已加入WTO ,它要求严格的合乎国内法律和WTO规则的行政执法行为。因此加强农业行政执法体系的对策研究具有非常重要的意义。着重指出我国现行农业行政执法中存在的主要问题 ,并在此基础上 ,相应地提出完善我国农业行政执法体系的对策。

The agriculture administrative laws, as total consistence of the legal system of agriculture,include principle,parties,activities and enforcement procedure and supervision mechanism of agriculture administrative laws and so on.Agriculture laws execution is the poor section in the construction of the China agriculture laws.As well as it is key section for regulation by laws,especially for China to access to the WTO, it demands to abide by the domestic laws and WTO’s regulation strictly.Establishing and improvement China agriculture administrative execution system is key to strengthen the agriculture administrative execution.In this paper,the issues of the existence China agriculture administrative execution system are pointed expressly and main measures of the improvement on China agriculture administrative execution system are taken accordingly.
