我国公司法监事资格制度的完善——与德国立法之比较

The Comparative Study with German Legislation:the Perfection of Supervisor Qualification System of Chinese Corporate Law

针对公司监事任职资格问题 ,将我国公司法有关规定与大陆法系先进国家德国的立法例进行比较 ,并在尊重我国公司运作现状的基础上借鉴德国立法的成熟规定 ,对我国公司法监事资格制度的完善提出自己的看法及改进的建议。

This paper focuses on the supervisor's qualification system in a company.Compared with the legislation in Germany,where there is advanced continental law system,the supervisor qualification system of Chinese corporate law should be perfected according to the specific conditions.
