司法权研究的历史与现状分析

The historical and present analysis on the study of judicial power

司法权是人类社会在解决矛盾和纠纷的过程中分化出来的一项重要的公共权力 ,自从它产生后 ,如何设计一种比较合理的制度 ,保证这项权力能够最终实现社会正义的研究 ,就一直经久不衰。本文通过对司法权研究进行历史回顾 ,对我国司法权研究现状中存在的问题予以分析 ,指出在建设民主政治和法治国家的前提下 ,在司法改革深化的政治和社会背景下 ,为什么我国必须正视和重视司法权研究的必要性。

Judicial power is a divided important public power in the process to solve contradictions and dispute in human society. After it was produced, the study to design a rational system in order to ensure that it can realize social justice has been going on. This paper points out why we must pay attention to the study of judicial power and analyses the problems in the current study.
