我国现行民事诉讼法中没有明文规定诉讼系属中当事人移转诉讼标的的债的关系的处理模式 ,在市场经济高速快捷运作背景下 ,此种状况会严重妨碍当事人的交易自由 ,造成正当当事人的经济损失。文章比较了德国和日本的立法政策及其理由 ,指出我国应采用当事人恒定主义的处理模式 。

In our current civil procedural law, settlement of debt relationship about transferring the object of action by litigant is not proclaimed, which will hinder the freedom of trade seriously, and cause economic losses of the proper party under the high speed operating market economy. Comparing the legislative policies and reasons between Germany with Japan, this article points out the client eternally-fixed doctrine should be adopted in our country and illustrates the related law issue and settlement.
