Protection of Patent Right and Abusing the Dominance for Market

《专利法》保护专利权人的垄断权与反垄断法的禁止滥用市场支配地位制度应保持平衡。鉴于专利垄断的特殊性 ,对其滥用市场支配地位的管制应相对宽松 ,反垄断法的规则应当灵活。

Patent owner' monopoly protected by the “Patent Law”should maintain its equilibrium with the system of banning abusing the dominance for market in “Anti-monopoly Law”. Because of the particularity of patent monopoly,the control of abusing the dominance for market should be relatively loose and the rules of “Anti-monopoly Law” should be flexible.
