本文主要从法理的角度对转基因食品安全保障的正当性基础寻找法律上的依据,其理论依据源于人的安全需要和对人权的保障。因此,明确了保障人的健康权和环境权的必要性,转基因食品安全性的法律保障机制的正当性基础也就可以得到说明。

This paper seeks, on a justified basis, legal support for justification of the safeguard for the genetically modified food from a jurisprudential perspective, theoretically originating from the human need for security and from the protection of human rights .The legal safeguard system for the security of genetically modified food will be justified in a clear knowledge of the necessity of safeguarding human health and environments.
