博弈论是广泛应用于政治学、经济学、管理学、社会学、军事科学等领域的一种现代系统理论,“纳什均衡”是一种非合作博弈均衡理论,这一理论的诞生和发展带来了一个管理新时代。在知识产权管理新兴领域中,权利人与大众就知识产权权利进行博弈,作为执法者和管理者,应该充分发挥职能作用,尽力保证这一领域管理中的平衡和稳定,并利用博弈理论来指导知识产权管理。

Game theory is a modern systematic science that has been widely applied to many fields such as politics,economics,administration,sociology,military science,and so on.“Nash equilibrium”is actually a non-cooperative game theory that is a milestone of the resultant new age.As far as intellectual property concerned,there is a game between the proprietor and the public.The legislator and administrator in intellectual property field should perform their line of duty,ensure the equilibrium and stability in this field,and use the game theory to direct the administration of intellectual property.
