是内阁制还是总统制

Cabinet's System or President's System

长期以来 ,学术界对《中华民国临时约法》所确立的政体认为是责任内阁制。从其条文入手 ,通过与实行典型总统制政体的美国及责任内阁制政体的英国的比较 ,可以确认《临时约法》所确立的政体实际上是兼有总统制和内阁制因素的混合政体。

For a long time,academic circles have regarded the government's system established by “the Provisional Constitution of the Republic of China” as cabinet's system of responsibility.From analysing its clauses and through comparing the typical government's system of cabinet's system of responsibility in Britain.we believe that the government systme established by the “Provisional Constitution” is the blending body in fact which contains factor of both presient's system and cabinet's system.
