国际货物买卖中,货物所有权转移与买卖双方的基本权利的实现关系密切,与一方当事人破产后,另一方当事人权利的实现以及货物风险的承担密切相关。但是,各国在所有权转移的法律规定上存在严重分歧,这严重阻碍世界经济的发展。制定统一的所有权转移的实体法公约因此势在必行。

In the process of international of goods ownership is closely related to the realization of both sides' essential rights. It is also closely related to the fact that one interested party should make sure that the rights be realized and assume the risk of goods when the other party goes bankrupt. However, countries all over the world differ greatly over the legal regulation of ownership's passage. This difference gravely impedes the economic development in the globe; hence the necessity and certainty of establishing a unified substantive law pace on the passage of ownership.
