Comment on the Current Situation of China's Legislation of Social Insurance

中国的社会保险立法近年来取得突破性进展,初步构建了以养老、医疗和失业保险为重点的社会保险法律制度总体框架,在立法形式、内容、思路及立法技术等方面都具有自己的特点,但还缺乏合理的理念和明确的价值取向,社会保险法律法规数量少、层次低,立法分散,不成体系,缺乏综合性社会保险基本法,灵活就业人员的社会保险问题尚无统一的全面规定,法律实施机制也较弱,需要进一步加以健全和完善。

The framework of the social insurance legal system has been initially constructed in China, which emphasizes on pension insurance, medical insurance and employment insurance. There are some distinguishing features in form, content, and train of thought and technique of China's Legislation of social insurance. There also exists some faults, thus it should be strengthened and perfected.
