摘要
人民调解制度是从中国古代社会的诉讼外调解演化发展而来的,它是一种运用说理、疏导的方式来排解民间纠纷的群众性自治制度;它体现着中国独特的民族文化、心理、世界观和价值观念,是我们党创造性地将传统法律文化实现向现代性转变的成功范例;它不仅有助于社会主义制度的建设与完善,有助于建立良好新型的人际关系,而且有助于推动世界社会文明的发展与进步。
The paper surveys the legal nature, cultural elements and the contemporary significance of the civil mediation system that has evolved in China through the centuries, maintaining that it comes from ancient China's out-of-the-court mediation practice, operates on the basis of spontaneous reasoning and persuasion, embodies the unique cultural, psychological and communal values of the ancient Chinese people, and is the very foundation upon which the Communist Party creatively established its own mediation system in the modern context. The system functions today not only to help improve the socialist ideology, establish fraternal relations among the people, but also to promote civilization at a world-wide scale.
