关于行政许可的性质,理论上众说纷纭。从我国《行政许可法》所规制的行政许可的类型看,可以认为行政许可的一般性质是对符合条件者的不作为义务的解除。在行政法上,行政许可是具有形成力的授益性行政法律行为。
