论当代中国宪政秩序形成的障碍因素及实现途径

On the Obstacles and the Approaches to Construct China Constitutional Government

在当今中国通往法治道路的征程中,摆在国人面前的首要任务应当是改变那种历史积淀下来的有宪法无宪政,有民主形式无法治精神的现实。以2004年的宪法修改为契机,文章从分析宪政的基本理念入手,在探索了西方宪政秩序的发生机制和研究了当代中国宪政秩序形成的各种障碍因素之基础上,提出了我国构建民主、稳定的宪政秩序的具体方案。

On the road to legal system in taday’s China, it is the essential mission to reform the state that is of a mixture of constitution without constitutional government and a democratic form without the essence of law. Regarding the constitution taking modification in 2004 as the chance, this artical starts form the basic principle of constitutional government, exploring the original system of the western counties constitutional government and obstacles decelerating the construction is constitutional government in modern China,and brings forward possible solution of shaping a democratic and stable order of constitutional government in China.
