Analysis of the Parties' Burden of Proof in “Regulation of Proofs”

证明是诉讼活动的重要组成部分。在审判方式改革的指导下,当事人对诉讼活动的决定性作用意味着当事人应在证明活动中扮演重要角色。于2002年4月1日施行的《最高人民法院关于民事诉讼证据的若干规定》亦对此当事人举证问题作了详细的说明和解释。

Proving is an important component in the proceeding. Under the direction of the reform of the trial methods, the concerned parties' decisive function in the proceeding justifies their playing critical roles during the process of proof, and the 'the Supreme Court's Re regulation of proofs in civil proceedings', which was enacted on 1st April 2002, provided a detailed explanation and construction of the problem of the parties' burden of proof.
