试论证人免证权

On the Privilege of Immunity of Witness

为了最大限度的打击犯罪 ,我国法律规定了证人作证的绝对义务 ,然而从价值平衡的角度、人性化的角度、以及维护社会稳定的角度来看 ,证人免证权的建立将是实现证人权利保障的必然趋势。

In order to strike maximum blows at criminals,our law stipylates the absolute responsibility on the part of witnesses. However,the establishment of the witness' privilege of immunity is inevitable for ensuring the rights of witnesses from the perspective of the balance of values 、humanity and social stability.
