中国死刑之现状与走向

死刑是一个永恒的话题 ,也是国际社会关注的焦点。当今世界虽然大部分国家和地区业已废止死刑 ,但中国大陆尚且存置死刑 ,并且刑事立法中死刑罪名较多 ,重刑化倾向太浓 ,进而导致刑事司法中死刑适用的泛化。现阶段中国死刑之关键不是废止死刑 ,而是扩大死缓适用 ,以死缓替代死刑立即执行 ,以减少死刑的实际执行 ,并借助于这一契机对死刑适用进行全面革新。中国之死刑 ,在立法上大有压缩之空间 ,在司法中尚需理性与慎重。

Being an eternal theme,the death penalty is an international focus and is having been abolished in most countr ies or territories.However,there are many accusal names existed in China's penal law,and the death penalty is being applied widely.The only pertinent way is to expand the application of death sentences with a suspension of execution,and eve n use it instead of the death penalty gradually in order to reach the goal of ab olishing the death penalty ultimately.The Chinese death penalty can be deduced i n legislation and should be dealt with by reason and prudence in jurisdiction.
