论经济法律责任的称谓和二元属性

On Title and Attributes of Legal Liabilities for Economy

经济法律责任是指在国家干预和调控社会经济过程中因主体违反经济法律、法规而依法应承担的否定性、单向性、因果性经济义务。“经济法律责任”与“经济法责任”的称谓没有明显的差异,两者不存在准确与否的区别;经济法律责任的存在具有二元性:从其产生的依据来看,具有相对的独立性,因为它直接产生于经济违法行为,不从属于其他的违法行为。但是从责任的实现方式来看,又具有从属性,经济法律责任只有通过行政制裁和刑事制裁来实现,不存在与民事制裁、行政制裁和刑事制裁相并列的、完全独立的经济制裁。

Legal liabilities for economy is negative, one-way and causality economic duty that subject should bear against economic laws in the course of governmental intervention, adjustment and control in society economy. Title hasn't obvious difference between legal liabilities for economy and economic law duty, and both of them don't exist distinction of accuracy, existence of legal liabilities for economy has attributes. It has relative independence from its emergent basis, otherwise it has subordination from the way of duty realizing.
