摘要
共有物分割有认定主义和移转主义两种立法体例。在分割已设有抵押权的共有物时 ,采用不同的立法体例对已设的抵押权影响很大。通过对两种立法体例的比较可以看出 ,认定主义在理论和实践上更加合理。
Division of property in common can be carried out according to two legitimate systems, maintenance approach and transference approach. While dividing the property which has mortgage right, employment of different systems has a great impact upon the established mortgage. Through the comparison of the two systems, maintenance approach is more reasonable both in theory and practice. On such a basis, this paper analyzes the fulfillment of mortgage right in the two systems.
