A Tentative Discussion on the Alteration of Real Rights: Its Public Revelation and Public Trust Principles

物权的公示、公信原则是物权法的基本原则之一。物权公示原则是贯穿于物权法之动态范畴的基本原则,通过典型或非典型的公示形式将物权变动状况加以展示,从而决定物权变动效力的法律原则。而公信原则通过保障物权交易的安全,能增强公示制度的信用。

Public revelation and public acceptance principles of the alteration of real rights are two basic principles of real rights law. The principle of revealing real rights to the public is fundamental to the dynamic category of the law of real right. It displays the altered condition of real right to the public in typical and non-typical forms of revelation, and decides the legal efficiency of the alteration of real right. Public trust principle strengthens the credit of the public revelation principle through securing the transaction of real right.
