论外资银行的法律监管

An Analysis on Legal Regulation over Foreign-funded Banks

目前 ,我国对外资银行的监管与发达国家相比还存在着较大差距 ,具体表现为法律依据不完备 ,监管制度与模式存在缺陷 ,监管工作重心不到位 ,监管手段不完善 ,外资银行享受过高或过低的国民待遇等。针对这些问题 ,我国应采取相应措施 ,如制定《外资银行法》、加强与母国监管方面的合作、加强银行业的自律管理等 。

At present, there is still rather a big difference in the regulation over foreign funded banks in company to that in developed countries, which is embodied by incomplete legal bases, regulatory system and model with defects; regulatory focus is not to the point; imperfect regulatory means, too lower national treatment for foreign funded banks; etc. Corresponding measures should be taken to solve above problems, such as to formulate Foreign funded Bank Law, to intensify cooperation with mother country in terms of regulation, to strengthen self discipline of banking industry, in order to regulate effectively over foreign funded banks.
