摘要
我国建设用地的土地使用权获得有两种方式 :划拨和出让。出让土地使用权是市场经济的产物 ,适合市场的发展 ,但也存在着根本性的弊端和自身无法解决的问题。划拨土地使用权虽然存在不少弊端 ,但也有其他制度无法替代的优点。对这两者 ,不应是一存一废 ,而应是予以完善 ,充分发挥各自最大的优势。
Allocated land-use right and granted land-use right are two ways that a construction unit obtains the land-use right in China. The system of granted land-use right adapts to the developing of market economy,but it has radical disadvantages and incapable solved problems by itself. The system of allocated land-use right has many disadvantages too,but it has the advantages that other systems cannot substitute. Nowadays,two systems should be remained,but both should be improved.
