美国宪法上的福利权论争——学理与实践

摘要本文回顾了美国福利权发展的历史,对围绕美国福利权性质所展开的若干学理问题进行了梳理。并以法院受理和审理福利案件的过程为分析脉络,从司法节制、诉讼成本、制度选择和判决实效等角度,分析了福利案件司法审查过程中需要面对的诸多因素和问题。 This article gives a brief review on the development of welfare right in US. It discusses several doctrinal questions on the nature of welfare right in US,according to court judgment process, from the aspect of judicial restraint, litigation cost, institutional choice and decision effect, to analysis the related factor and problem in judicial review process of welfare case.
