关于商标淡化的立法与完善

Commenting on the Legislation ofTrademark Dilution and Its Performance

通过对商标淡化理论在各国以及在我国的立法体现的比较分析,指出我国新修订《商标法》对驰名商标反淡化保护的不足之处,并对我国商标淡化立法的完善进行构思。

By analyzing and comparing the legislation embodiment of the theory of trademark dilution in our country with that in other countries, the present paper resolves to point out the weaknesses of the anti-dilution protection of famous trademark in the newly-revised Law of Trademark of our country, and to work out a way of perfection for the legislation of trademark dilution in our country.
