新公共管理视角下的行政主体研究

A Research on the Administrative Subject from the View of New Public Administration

新公共管理主张的地方分权、自治与企业化经营的政府理念,与我国市场经济发展及民主政治建设的要求不谋而合,为此,尝试从新公共管理的视角审视并重新界定与建构我国行政法学上的行政主体制度,很有理论意义和现实意义。行政主体制度框架应为行政组织法、行政编制法、国家公务员法、国家赔偿法前提下的国家行政主体、地方行政主体、公务法人。

Thegovernmental concept of decentralization, local autonomy and running as businesses advocated by New Public Administration happens to agree with the development of market economy and democraticpolitics in China. Therefore it possesses theoretical and practical significance to review, re-define and reconstruct the administrative subject theory. The pattern should be constituted by state administrative subject, local administrative subject and public body corporate presupposing the existenceof Law of Administrative Organization, Law of Administrative Staff, Civil Service Law and State Indemnity Law.
