摘要
建设工程的招标行为应是要约邀请而非要约 ;而投标行为应是要约而非承诺。因而中标通知书不能意味建设工程合同的成立 ,但因现行立法的缺陷 ,从应然意义上 ,中标通知书应导致建设合同的成立。
The action of invitation to bidding in the construction project is an invitation to offer but not an offer, while a bid shall be an offer but not an acceptance. Therefore, a bid-winning notice does not mean the establishment of a contract for construction project. However, because of the limitations of legislation, the bid-winning notice shall lead to the establishment of a contract for construction project.So the relevant legislations shall be amended and perfected.
