摘要
我国立法还没有关于替代责任的规定 ,雇员侵权案件的审理 ,尚无法可依。应借鉴国外的相关立法 ,在民法典中规定雇主替代责任制度 ,对雇主、雇员的连带责任、雇主的追偿权等问题作出明确规定 。
There is no provision about the vicarious liability in the legislations of China. Therefore, there is no legal basis for hearing the cases of employees' torts. Relevant legislations of foreign countries shall be borrowed as a reference to prescribe the vicarious liability of employers' in the civil code and to explicitly define the joint and several liability of employees, and employers' right of recourse in order to provide legal basis for the settlement of relevant disputes.
