西方五国教育立法的主要特征及我国教育立法的借鉴 被引量:6

摘要 美、英、德、法、加等西方五国普遍重视教育立法,其教育立法有着广泛的内容、健全的体系、规范的程序、完善的技术、严格的监督系统,而且强调教育立法的与时俱进。我国教育立法可以从中获得有益借鉴:必须坚持“依法治教”,注重教育立法与教育改革的相互促进,完善教育法规体系,规范教育立法程序,改进教育立法技术,强化教育法律监督系统,丰富教育立法的表现形式。 Five countries in the West attach great importance to educational legislation (EL). Their EL has extensive contents ,complete system, normal procedure, perfect technipues and strict supervisory system of educational law. An excellent cycle between EL and educational reform has formed. They have experiences in EL for our country. For Example,we must persist in the way of law in education,paying attention to promoting each other of EL and education reform, perfecting the system of educational regular items, normalizing the procedure of EL, improving the techniques of EL, enforcing the supervisory system of educational law and enriching the acting patterns of EL.
