Study on the Legislation of Family Violence

家庭暴力是发生在家庭成员间的一种违反法律与善良风俗的暴力行为,它已成为一个全球性的社会问题。在许多国家,防止家庭暴力的法律改革已经展开。在我国,解决家庭暴力的相关政策仅仅是一种高层次的伦理规范,而不是法律规范。家庭暴力纠纷案件的增多对现行法律体系提出了挑战。制定一部统一的反家庭暴力法,是促进我国法律体系的发展,进而实现我国法制现代化的时代使命;基于此,法院内部也应设立一个专门的解决家庭暴力纠纷的家事法庭,并构架起此领域的公正审判权,从而树立起司法权威,这是实现司法公正与正义的必然选择。家庭暴力立法与司法制度的发展,对法学研究也具有重要的制度价值。

Family violence violates the law and good customs. It is a social problem of the world. In some countries, reform of present law to prevent family violence has been put into practice. The Chinese policy to settle the problem of family violence is only a kind of high-level codes of ethics, other than codes of law. The increase of cases caused by family violence is a challenge for the present law system. It is epoch mission for the improvement of legislation to realize the modernization of Chinese legal system to construct the law against family violence; on the basis of this existing law, it is a necessary choice to contribute the right of fair trial for the realization of judicial impartiality and judicial authority by constructing a particular Household Court. Accordingly, the development of legislation and practice against family violence can also give great systematic value to the study of law science.
