论委托作品的著作权归属

只允许用于商务活动的委托作品约定著作权归属,合同未作明确约定或者没有订立合同的,著作权不归受托人,而归委托人,符合我国《著作权法》立法精神,有利于调动委托人投资企业进行知识创新的热情,以促进知识产权的发展。
