论我国网络隐私权的法律保护

The legal protection of right of network privacy

随着网络技术的飞速发展和在国际范围内的普及,侵犯隐私权的手段也呈现出多样化、隐秘化等新特点,形成网络进一步深化发展的潜在阻碍。在借鉴国内外有益做法的基础上,我国保护网络隐私权应做好以下几个方面的工作:加强网络立法;政府积极管制和行业自律相结合;成立专门保护隐私权的机构以及强化信息主体的自我保护。自主原则、无害原则和知情同意原则应成为保护网络隐私权的几项基本原则。

With the great development of worldwide and adoption of network , the measure which violates the right to privacy submits new characteristics, such as diversification, hidden and so on. It has been a potential obstacle in the way of developing network. This article commences from the content of the right of network privacy, analyze the actual threat to it, and draws lessons from the domestic and international beneficial way of doing, points out that the protection of the right of network privacy in our country should do as follows enhance the network lawmaking; The positive control in government combines together with the profession self-discipline; establish the organization to protect the right of privacy,and enhance the self-protection of the information subject. In addition, it points out that the independence principle, harmless principle, and informed consent principle should become basic principles protecting the right of network privacy.
