我国“私人侦探”的若干问题

Discussion on Several Questions about "private detective" in Our Country

目前,我国各种形式的"私人侦探"或公开或隐蔽地存在人们生活中,而这与我国现行法律存在冲突。在我国,法定意义的侦查权是不能由私人享有的,当事人只能在法律许可范围内从事不侵害公民合法权益的相关调查活动。"私人侦探"的存在有着一定的社会原因,同时也会引发一系列的社会问题。我国不应也无必要设立所谓的"侦探业"。在现行法律框架下,完全可以通过相关办法解决群众需要、市场需求的问题。

At present, all kinds of'private detectives' exist openly or conceal in different forms in our country, evading law at the same time. Thus, the current law of our country has conflicts with 'detective'. In fact, investigation right of legal meaning can't be enjoyed by the individual in our country; the litigant can only be engaged in investigating activity permitted by law, which doesn't encroach on relevantly lawful rights and interests of citizen. The existence of 'private detective' has certain social reasons. Meanwhile,it will cause a series of social concerns. In our country, it's unnecessary to set up so-called 'detective vocational' too. Under the current law frame, the problem of masses' needing, market demand can be solved through the relevant method eventually.
