摘要
提单是国际海上货物运输中最重要的单据。在履行提单的权利义务方面 ,主要的法律问题集中在承运人的责任方面。从本世纪 2 0年代到现在 ,承运人的责任制度发生过并正在发生着重大变化 ,而这些发展变化主要是通过《海牙规则》、《维斯比规则》与《汉堡规则》三个国际公约表现出来的。我国不是三大国际公约的缔约国 ,但我国的《海商法》吸收并反映了公约对提单的法律调整的有关规定。
B/L is the most important document in the international maritime goods transpo rt. The main legal problem is centralized in the carriers responsibi lity in fulfilling the right obligation of B/L. From 1920s to now, the carriers responsibility system has greatly changed and the chang es are mainly reflected by the three international conventions of Hague Rules,Visby Rules and Hamburg Rules. Although our country isnt the c ontracting parties of the three international conventions,yet the Mariti me Law of our country has absorbed and reflected the law adjustment r egulations of B/L.
