摘要
朱熹作为宋代哲学家,把自然、社会、人生问题统一于“理”之下,然而他又有着精彩的法制思想。笔者结合他的本体论、心性学说和认识论。分析其法制思想的三个方面:法自理出;存天理、灭人欲的法制思想总纲和严刑以威的重刑思想。
Zhu xi, a philosopher in Song Dynasty, tried to seek unity of nature, society and life under 'Li', while he also had brilliant legal thoughts. This article integrates his ontology with epistemology and theory of human nature to analyze three aspects of his legal idea: the thought that Law comes out of Li; the general legal principles that we should preserve Li and repress human desires; the idea of exerting severe penalty to show power.
