惩罚性赔偿制度是英美法系特有的制度,其出现和发展有其深厚的理论根基和时代背景。该文着重分析该制度的损害填补与威慑预防功能,以及适用惩罚性赔偿制度的重要性与可能性,并结合国外立法经验对我国惩罚性赔偿制度的构建提出了立法建议。

Punitive damages is one of the legal rules initially applied in common systems, which can compensate victim for the loss, punish and deter injuries from behaviour against law. By exploring the process of the application of punitive damages in the common system, this paper probes into the rationality of its application.
