摘要
惩罚性赔偿制度有着悠久的历史 ,已被当代各国立法所接受。我国的《消费者权益保护法》明确规定了惩罚性赔偿制度。但是由于立法技术、司法实践、社会观念等限制 ,该制度在我国的应用过程中出现诸多弊端。文章借鉴各国的立法例 ,结合我国的司法实践对该制度的应用提出进一步的完善。
The punitive compensation rule has a long history in practice and has been accepted by the legislation of modern countries. This rule is clearly stipulated in China’s “Law of Protection of Consumers’ Rights”. However, limited by legislation technology, judicatory practice and social conception, this rule has been accompanied by much malpractice in its implementation. Using foreign countries’ legislation for reference and taking China’s judicatory practice into consideration, this paper offers some proposals for its improvement.
