网址标识所标识和商标所标示的商品、服务可能有混淆之处,为保护消费者的利益,商标的效力应自动延展至网络。但在网络上,商标应仅取得禁止权而无使用权的效力,且禁止范围有一定限制。网络标识持有者仅在故意的情况下才能构成商标侵权,且不适用过错推定原则。
What website marks symbolize is sometimes similar to that of trademarks so that they will confuse the consumers.In order to protect the consumers,a trademark holder should automatically have some right in network,but his right should be confined to forbid others to offer similar commodities or services in the website and not to use the website mark.The website mark holder will commit a infringement by bad faith but has no duty when he is only negligent.
