“性贿赂”使得行贿人对受贿人的“关照”从物质层面上升到感官、精神层面,在“体贴入微”的同时更具隐蔽性;“性贿赂”侵犯了国家工作人员职务的廉洁性,具有比财物贿赂更为严重的社会危害性,是贿赂犯罪的一种新形式。“性贿赂”呈愈演愈烈之势,道德的调整已不足以抑制其危害,惩治性贿赂犯罪不违背刑法的谦抑性。
