违约的精神损害赔偿是一个在理论上有颇多争议,在我国立法上未作明确规定,司法实务中又确实存在且亟须解决的问题。本文通过比较研究的方法,考察他国在这方面的立法及判例、学说的发展情况,提出违约精神损害赔偿的一般限定原则。

The spiritual claim against breach of the contra ct has still a lot of controversy,which has no definite regulation in our law syst em.However,there really exist some urgent problems to solve in judicial practice .The article tries to research it comparatively,investigate the development othe r country’s legislation,judicial precedent and the theory of it,finally puts forward some suggestions to its legislation in our country.
