民事责任原则重构——补偿性责任价值质疑

On the reconstruction of the Rinciples of Civil Liability——Questioning on the compensatory liability value

补偿性责任几乎是我国目前确定民事责任的唯一原则,笔者对其操作价值,补偿与救济价值,惩罚、教育、预防和遏制价值,以及平等、公平、公正、正义价值进行剖析,建议重构民事责任原则,即确立补偿性责任为一般原则,惩罚性责任为辅助原则,限制性责任为例外原则,一元钱赔偿为适当适用的原则。

Compensatory liability may be the only principle to determine the civil liability in China currently.Analyzing the value of practice,the value of compensation and salvation,the value of punishment,education,prevention and deterrent,and the value of equity, fairness and justice,the authors propose the reconstruction of the principles of civil liability,i.e.the compensatory liability should be established as general principle,the punishment responsibility as sub- principle and the limitation of liability as exceptional principle,the one- yuan- compensation as principle of application.
