建筑物区分所有人之成员权性质探究——兼论《民法典》中之相关制度安排

The Discovery and Analysis of the Quality of Membership Right in Condominium

关于建筑物区分所有人成员权的性质,在民法学界颇有分歧,盖有物权下的权利说与物权下的权能说两种。本文在评析该两种学说的基础上,提出建筑物区分所有人的成员权并非物权,而是成员权,属于人身权的一种。并进而对民法典制定中对成员权的立法提出了几点建议。

The scholars of civil law in academic circles have two different views on the quality of membership right in condominium:One theory regards it as a property right,the other regards it as a function of property right. This thesis criticizes both theories and concludes that the quality of membership right in condominium is not property right but personal right.Furthermore,some suggestions on the legislation of membership right in Civil Code are also raised in this thesis.
